With the signing of HB6859, there is finally a fix (on or after Oct 1, 2025) to the problem with the 3 handgun in 30 day limit language that impacted some. People were finding that they couldn’t receive more than 3 handguns via bequest or intestate succession, or, upon the death of a testator or settlor, to a trust, or from a trust to a beneficiary. They’d have to wait the required time before any additional handguns could be bequested or transferred from the deceased person. HB6859 among a number of other changes, added the following exemption, in bold, to the 3 handgun a month language to address this issue:
(2) No authorization number issued for any of the following purposes shall count toward the limits in subdivision (1) of this subsection: … (E) any firearm transferred by bequest or intestate succession, or, upon the death of a testator or settlor, (i) to a trust, or (ii) from a trust to a beneficiary.
